Enforcement

Current Status:

With passage of the Umbrella Final Agreement on February 14, 1995, enforcement of trapline regulations became considerably more complicated by granting enforcement authority to First Nations on Settlement Lands and by-law recommendation authority to RRCs. Trapline allocation authority was also split between YTG and the First Nation and involves the RRCs in monitoring and advisory roles.

Concern:
Everyone involved with trapline regulations and enforcement is confused by the new UFA regime.

Solution:
Provide a simple explanation of how traplines are regulated under the UFA.

Concern:
By-laws recommended by the MDRRC cannot be enforced by YTG and NND.

Lands & Policies

Current Status:

The potential for wilderness tourism in NNDTT is high but little is offered at present. One apparent option is for trappers to use their trapline facilities for tourism. With respect to policies concerning the purchase of traplines, matters regarding the inclusion of assets in the evaluation have confounded NND initiatives to purchase traplines in accordance with sections 16.11.5 and 16.11.6 of the Umbrella Final Agreement.

Concern:
Trappers are not sure about laws regarding wilderness tourism on traplines.

Solution:
Facilitate wilderness tourism on traplines.

Group Areas

Current Status:

There are no group trapping areas in NNDTT except for a 5 mile radius around the community of Mayo. Group trapping areas can only be held by a First Nation - not an RRC. A group area can be created at any time by NND as long as it informs the territorial government.

Concern:
Some traplines are not utilized and people want to trap but have no opportunity.

Solution:
Make it possible for more people to get involved in trapping.

Unused Lines

Current Status:

Under section 16.11.10, the MDRRC is instructed to regularly review the use of traplines and make recommendations to the Minister and First Nations on the assignment and reassignment of all new, vacant and under-utilized traplines.

Concern:
Some traplines are unused but are not being transferred to active trappers.

Solution:
Encourage active use of more traplines in NNDTT.

Opportunities

Current Status:

There are many attractions of the trapping lifestyle which is seen to be practiced by a few experienced people in the community. Those with little or no experience in this occupation may feel that it is impossible to break into or is too big a risk without any experience or support.

Concern:
It is difficult for potential trappers to learn about trapping and experience the lifestyle.

Solution:
Encourage others to get involved with trapping and experience the lifestyle.

Compensation

Current Status:

In cases where a trapline is withdrawn by YTG for reasons other than mismanagement by the trapper, compensation is paid to the trapper based on the average net profit from the trapline over the preceding three years. Recommendation to not renew a trapline is made by YTG to the Concession and Compensation Review Board where the trapper can make representation. Since 1988 the Board has upheld 22 recommendations by YTG and overturned 8. There is no compensation for loss of lifestyle or improvements to the line etc. Also, no compensation is paid if the line is destroyed by wildfire. Where a trapline is affected by a development such as mining, in order to be granted a water licence, the proponent must demonstrate that compensation has been negotiated with the trapper or else the Water board will determine the compensation to be paid. Where developments do not involve the Water Board or YTG and compensation is not agreed to, the trapper must take the case to the Federal Court.

Concern:
The MDRRC feels that compensation by YTG does not reflect the true value of the trapline.

Solution:
Review YTG policy on compensating a trapper for loss of line or negative impacts.
